This privacy policy will help you understand how your personal data is collected and processed by BETTERCONTACT, a French simplified joint stock company, with its registered office at 11 rue du Puits Gaillot, 69001, Lyon, France, registered with the Lyon Registry of Companies under company number 882 799 372 (hereinafter, “BetterContact” “we”, “us” and “our”).

This privacy policy applies to the processing of personal data relating to website visitors, prospective customers, existing customers and their authorized users, in connection with the provision of our services and the management of their commercial relationship with BetterContact.
It also applies to the processing of personal data relating to certain business profiles that we make available to our customers and their authorized users as part of our data aggregation and enrichment services. You may opt out of the processing of your personal data for such data sharing purposes at any time, either by contacting us through the channels described in Section 4 below, or by submitting a request via our Opt-Out form available here.
However, this policy does not apply to personal information that BetterContact receives from a customer, or otherwise processes on a customer’s behalf, in connection with the services provided under an applicable services agreement. Such data is processed by BetterContact strictly in accordance with the instructions of the relevant customer, as set out in our Data Processing Agreement.
1. What personal data we process and why

This processing is also based on the legitimate interest of our customers in enriching their B2B lead data for marketing and similar business purposes. You may opt out of the processing of your personal data for such data sharing purposes at any time by contacting us through the channels described in Section 4 below or by submitting a request via our Opt-Out form available here. | We store and use your contact information (such as your telephone number and email address) in our database in order to enrich the contact details of business profiles used by our customers through our services. | We collect this information from two main sources : Our customers, who may upload and save their contact database when using our services; Our trusted data providers, from whom we lawfully obtain professional contact information. It will then be retained on the BetterContact account of this customer for as long as the user’s account remains active. We also store this information in our central database, so that other users can access it when enriching the same business profile. However, we do not retain this data indefinitely. If no request is made to access this information within a period of three (3) years, it will be deleted from our database. Should a new user attempt to retrieve this data after deletion, it will only be processed again if made available by our data providers. |

2. Who are the recipients of your personal data?
Within our organization, only duly authorized personnel, such as members of our customer and technical teams, have access to your personal data, strictly for the purposes necessary to fulfill their duties.
If your personal data is included in the business profiles stored in our database, it may be made available to our customers and their authorized users as part of our data aggregation and enrichment services. However, any personal data uploaded to our database by an authorized user in the course of using the services is not shared with other users. This data remains accessible only to the customer who uploaded it and their authorized users.
We may also share your personal data with our technical and online service providers, including our cloud services providers. You can view the list of our third-party processors listed in our DPA listed on BetterContact’s website. Some of these providers are located in the United States and may access your data from there. In such cases, we have ensured that appropriate safeguards are in place to comply with applicable regulations on international data transfers. Personal data are shared with these technical partners in accordance with the contractual agreements signed with each provider, and such agreements may not override the provisions of this privacy policy.
When require under applicable law, we may have to disclose your personal data to public authorities. Our policy is to not respond to government requests for user data unless we are compelled by legal process or in limited circumstances in the event of an emergency request. However, if European law enforcement authorities have the necessary warrant, criminal subpoena, or court order requiring us to disclose data, we must comply. Likewise, we will only respond to requests from government authorities outside Europe if compelled by the government of a European country through procedures outlined in a mutual legal assistance treaty or agreement. It is BetterContact’s policy to notify affected users before we disclose data unless we are legally prohibited from doing so, and except in some emergency cases.
Finally, if BetterContact is acquired by or merges with another company, we don’t plan on that, but if it happens, we’ll notify you well before any of your personal information is transferred or becomes subject to a different privacy policy.
3. How is your personal data secured?
BetterContact is a European company and all data infrastructure is located in Europe.
We ensure that personal data is adequately and appropriately secured and have taken the necessary precautions to secure and ensure that our subcontractors respect the security and confidentiality of the data and in particular prevent it from being distorted, damaged or communicated to unauthorized persons.
All data is encrypted via SSL/TLS when transmitted from our servers to your browser. The database backups are also encrypted. In addition, we go to great lengths to secure your data at rest. Most data is not encrypted while they live in our database (since they need to be ready to be downloaded by you when you need them).
In the event that the integrity, confidentiality or security of your personal user data is compromised, we undertake to inform you as required by applicable law. If you choose to cancel your account, your content will become immediately inaccessible and should be purged from our systems in full within 60 days.
4. Your legal rights and how to contact us
In accordance with the European regulation on the protection of personal data, you benefit from the following rights:
- A right to withdraw your consent to the processing of your personal data at any time,
- A right of access enabling you at any time to know whether or not your personal data is being processed by our services and, if so, to have access to such personal data and to the information required by law concerning the way in which such data is processed,
- A right of correction allowing you to request that any inaccuracies concerning your personal data be corrected as soon as possible,
- A right to deletion, allowing you to request as soon as possible that your personal data be deleted when (i) its conservation is no longer necessary for the purposes for which it was collected (ii) you have objected to the processing and therefore wish it to be deleted (iii) the data has been unlawfully processed; (iv) the data must be deleted to comply with a legal obligation which is provided for either by European Union law,
- A right to restrict the processing of your personal data (i) when you contest the accuracy of the personal data collected for the period of time necessary to verify its accuracy, (ii) when, following a processing operation established as non-compliant, you prefer the restriction of the processing to the complete deletion of the data (iii) when the personal data are no longer necessary for the purposes of the processing operation but are still necessary for the establishment, exercise or defense of legal claims; (iv) when you have objected to the processing and you wish to limit the processing for the period of time necessary to verify whether the legitimate ground invoked are justified,
- A right to portability allowing you to receive your personal data in a structured, commonly used and machine-readable format, or to request that such personal data be transmitted to another controller, provided that such request for portability relates to personal data that you have directly provided to us and that concerns you and that such request for portability does not infringe the rights and freedoms of third parties,
- A right to object to the processing of your personal data on grounds relating to your particular situation and the processing will be stopped unless there are compelling legitimate grounds for continuing it in accordance with the applicable regulations,
- A right to set out instructions on the conservation, deletion and disclosure of your personal data after your death.

Complaints about the use of your personal data may also be addressed to the supervisory authority for the protection of personal data that is competent according to your place of residence, for example the CNIL if you live in France.
